By checking the “By placing your order, you agree to our Terms of Sale” box and clicking the “Place Order” button on the “Secure Checkout” Page, or by making any purchase at the Pride Car Audio Online Store, you acknowledge that you have read, understood, and agreed to be bound by the following terms and conditions, Pride Car Audio Website Terms of Use , and the Pride Car Audio Privacy Policy (available at http://www.pride.audio.com/privacy-policy-usa) (together, these “Terms”).

Payment transactions from www.pride.audio for the United States, Canada  will be handled and processed by Talex Audio LLC

The Terms and Conditions for such transactions shall be governed by and construed in accordance with the laws of Hong Kong without reference to Hong Kong conflict of laws rules, and any dispute shall exclusively be submitted to the competent courts in Hong Kong.

You must be at least 18 years old to place orders on the Pride Car Audio Online Store. If you are not eligible or do not agree to any of the Terms, then you may not use the Pride Car Audio Online Store to place orders.

Order Confirmation and Acceptance

Information contained at the Pride Car Audio Online Store constitutes an invitation to treat. No such information constitutes an offer by us to supply any products or service. By placing orders on Pride Car Audio Online Store, you declare and guarantee that you are legally qualified to agree the terms and conditions herein and conclude a binding sales and purchase agreement.

Order: The order you submitted through the Pride Car Audio Online Store is subject to acceptance by Pride Car Audio, and Pride Car Audio reserves the right to reject any order, in whole or in part, at Pride Car Audio’s sole discretion at any time before shipment or delivery, as the case may be. Reasons for rejections of order include, but not limited to, credit card rejection, out-of-stock products or service, and/or unusually large or excessive quantities of products or service ordered. Acceptance of one order is independent from any other order. Quoted prices may change due to shortages in materials or resources, increase in the cost of manufacturing, or other factors, up to the point we accept your order.

Confirmation Email: Once we receive your order and payment, we will send you a confirmation email. Your order should NOT be deemed accepted by Pride Car Audio until you receive the order acceptance email from Pride Car Audio. Pride Car Audio may require additional information from you prior to accepting or processing your order. Please notify Pride Car Audio immediately if any of the items listed in the confirmation email are incorrect.

Order Acceptance Email: Once we accept your order and prepare it for shipping, we will send you an order acceptance email. The email will include shipment details. In most cases, items in stock can be shipped within twenty-four hours. For items out of stock, you will receive the order acceptance email when the item becomes in stock and is prepared for shipping. You can cancel orders that have not yet been shipped from our warehouse. If you submit an order cancellation request after we ship your product, we will process your refund after the product is returned to our warehouse. You can login to your Pride Car Audio account to track your order’s shipment status. If you place your order as a guest, please check the emails sent by Pride Car Audio for any shipping information. In some cases that we fail to supply the product you have ordered after confirming your order, then we will cancel your order and offer you a refund.

Shipment and Delivery

Items in your order may have different shipping methods for you to choose from.

Standard Shipping:

The Estimated delivery time is 3-7 business days after order is shipped.

Express Shipping (Available in most of the areas)-For an Additional Fee:

We offer fast delivery option on certain delivery speeds and select products. When fast delivery is available on an order, you can find it on your checkout page, with the associated delivery date and fee. If a fast delivery date is provided and a delivery attempt isn’t made by or before this date, we’ll refund the fast delivery fee you paid with that order, within five (5) working days after you have signed for the delivery through our system.

Please noted:

The Estimated delivery times start when the item ships and any Estimated delivery times may vary according to your selected address. 

For your Standard Shipping service:

Unforeseen service delays (such as a strike, natural disaster, explosion, or any other force majeure event that is beyond the reasonable our control) add at least two to three business days to your Estimated delivery time. You acknowledge and agrees that any shipment dates specified are estimates only, they are not guaranteed and are subject to change, under such case, Pride Car Audio will send out notice regarding the revised shipment dates within 30 calendar days. If you do not accept the revised shipment dates, you may cancel the order and obtain a refund by contacting Pride Car Audio customer service. If we do not hear from you before we ship the products to you, we will assume that you have agreed to the shipment delay. 

For your Express Shipping service:

Please noted the requirements must be met to qualify for our fast delivery guarantee refund:

(i) Order is shipping to eligible address; 

(ii) If your order contains items that aren’t eligible for a fast delivery, we will split your shipment to ensure that you will receive the items that are available for fast delivery on time.

Our guarantee does not apply if we miss our promised delivery date because of the following:

(i) Unforeseen circumstance such as a strike, natural disaster, explosion, or any other force majeure event that is beyond the reasonable our control. 

(ii) If you cancel part of or the whole order after shipment, or if you change your items, change your contact details or change your shipping address after you place the order.

An attempted delivery on or before the promised delivery date meets our delivery guarantee. An offer by the carrier of a delivery appointment on or before the guaranteed delivery date meets our delivery guarantee.

General shipping terms:

Please confirm your address before payment. If you enter the wrong address, please contact Pride Car Audio Support in a timely manner. If you ask to change the address after the order has been shipped, we cannot guarantee that your order will be updated. In addition, you are responsible for all possible risks and expenses caused by changing the address after the order has been shipped. 

Delivery shall be deemed complete and risk of loss shall pass to the customers at the point of delivery. All shipping costs including, without limitation, insurance, brokerage, duties, freight are extra and are the responsibility of the customers. Please validate each shipment against the attached packing slips for accuracy of items and quantities promptly upon receipt. Upon discovery of any discrepancy between the attached packing slips and the shipment, such as missing, wrong, or damaged portion of the product, please notify Pride Car Audio immediately with the relevant damage claim(s) requested from the logistics company. Pride Car Audio may not be able to issue refund without relevant damage claim(s).

Product Availability

Product availability are subject to change at any time and without notice. Pride Car Audio reserves the right to place a limit on the quantities that may be purchased per order, per account, per credit card, per person, or per household. For preordered products, Pride Car Audio cannot guarantee to supply sufficient products to each order. If we are unable to supply the products or services that you ordered after confirming your order, we will cancel your order and offer you a refund. Pride Car Audio may, at its sole discretion, refuse or cancel any order and limit order quantity. Pride Car Audio will notify you in advance if such situation occurs.

Standard Refund and Replacement

In addition to the return and replacement services provided under the After-sales Service Polices ，as well as your statutory rights under applicable law, you may return a purchased item within 14 calendar days of the date the product is delivered to your address, for a replacement or a refund based on the original payment method*. Any returned item for such refund or replacement must meet one of the following criteria:

The item has no manufacturing defects, shows no wear or damage, unaltered from their original state, and in a condition that permits us to resell them. Please note that you need to send us a refund or replacement request before you return any items. Your refund and replacement requests can contact us or via Pride Car Audio online support.

Hardware Returns: If you are returning hardware, you must include the product(s), complete and standard accessories (includes but not limited to the charger, USB cable, user manual), the original manufacture packaging, valid proof-of-purchase(s) or invoice(s) and gifts to our designated address.

Software Returns: If you are returning software, you must also include all media and product keys. Since our software are subject to electronic download, we will cancel or modify the access to the download link(s) or the digital key(s) of the product upon your refund and replacement request. We may also require you to sign an electronic letter of destruction as a condition of refund and replacement of software products.

Failure to include items requested in this section may prevent or delay your refund or replacement. All shipping cost including, without limitation, shipping fee, insurance, brokerage, duties, freight for returned goods shall be at your own expenses. If you choose payment on delivery, we will deduct the delivery cost from your refund. Upon receiving the items, we will send you a test report. Once the return criteria are confirmed, we will refund or replace your product(s) as you request.

A refund or replacement will not be provided in following cases:

1. The product is not originally purchased from the Pride Car Audio Online Store.

2. The product is returned beyond 14 calendar days of the date the product is delivered to your address.

3. Products and/or product labels, serial numbers and packaging show wear, damage, or signs of tampering or alteration.

4. Product sent in for refund does not include all original accessories, attachments and packaging.

5. Valid proof-of-purchase(s) or receipts are not provided.

6. The virtual goods, gift cards and performed services are not eligible for return and replacement.

7. The goods are clearly claimed not applicable to the refund and replacement.

8. Bundle deals: For bundle orders that contain discounted products, refunds can only be processed for the entire order. Customers are not permitted to process separate refunds for individual products in a bundle deal.

9. Any other condition set forth in the After-sales Service Policies 

End-user Consumers Only

The Pride Car Audio Online Store sells and ships products to end-user customers only. You may not commercially distribute, publish, license, or resell any product or services obtained from the Pride Car Audio Online Store. We reserve the right to refuse or cancel your order if we have reasonable grounds to believe you are purchasing products for resale.

United States, Canada, and Mexico Shipping Only Products purchased from the Pride Car Audio Online Store will only be shipped to address within Canada, United States, and Mexico and are subject to applicable export control laws and regulations. Products must be purchased, sold, exported, re-exported, transferred, and used in compliance with these export laws and regulations. To purchase Pride Car Audio product online from other countries, please select your country or region through the Pride Car Audio Online Store.

Standard Warranty Policy

Pride Car Audio provides a one-year limited manufacturer warranty for any new Pride Car Audio branded product purchased at Pride Car Audio Online Store or other authorized distributors. The manufacturer warranty is separate from and in addition to consumer rights provided under the consumer law in your country/region where you purchase the product.

Export and Sanctions Compliance Requirements

This contract is subject to applicable export control and sanctions laws. You may not export any product purchased from the Pride Car Audio Online Store to another country if prohibited by export control and sanctions laws. If you do plan to export a Pride Car Audio product to another country, you must ascertain the export requirements and obtain any legally required export licenses (or other government approvals) prior to doing so, if applicable.

You may not, either directly or indirectly, provide any Pride Car Audio products to (i) any comprehensive sanctioned countries or regions, (ii) any sanctioned entity or individual, and/or; (iii) any prohibited countries or regions as required by Pride Car Audio.

Pride Car Audio products are designed, developed and manufactured for civil use, you may not, either directly or indirectly, use Pride Car Audio products for combat use or other purposes prohibited by applicable laws.

Governing Law

The Terms of Sale are governed by the laws of the State of California without regard to conflict of law principles. If a lawsuit or court proceeding is permitted under these Terms, then you and Pride Car Audio agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within San Francisco County, California for the purpose of litigating any dispute. We make no representation that the site or any materials included in the site are appropriate or available for use in your location.
